ORACUL Terms of Use

1. Introduction

ORACUL ("the App", "we", "us") is an astrology, divination and self-reflection application operated by Artur Avtukhov, an independent developer established in Italy.

These Terms of Use ("Terms") govern your access to and use of the ORACUL mobile application, the https://oracu1.com website and any related services (together, the "Service").

By creating an account, or by otherwise using the Service, you confirm that you have read these Terms, that you accept them, and that you agree to be bound by them. If you do not agree, do not create an account and do not use the Service.

These Terms work together with our Privacy Policy, available at https://oracu1.com/privacy-policy, which explains how we handle personal data.

2. Eligibility and 18+ requirement

ORACUL is intended solely for adults. You may create an account and use the Service only if you are at least 18 years old.

During registration you are asked to confirm that you are at least 18 years old. Providing a false confirmation is a breach of these Terms.

We do not knowingly permit the creation of accounts by people under 18. If we learn that an account belongs to a person under 18, we will close it and delete the associated personal data.

You must also have the legal capacity to enter into a binding agreement in the country where you live, and you must not be barred from using the Service under any applicable law.

3. Account registration

To use most features you need an account. Registration requires a name, an email address, a password, and the birth data used for astrological calculations (date, time and place of birth).

Your account is created only after you confirm ownership of the email address with the numeric code we send to it. Until the code is confirmed, no account exists and the details you entered are stored only temporarily.

You are responsible for the accuracy of the information you provide and for keeping it up to date. Inaccurate birth data will produce inaccurate calculations.

You are responsible for keeping your password confidential and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed by someone else.

4. User responsibilities

You agree to use the Service lawfully, and only for your own personal, non-commercial purposes.

• Keep your account credentials secure and do not share them.
• Do not create multiple accounts to circumvent usage limits, trial periods or restrictions.
• Do not attempt to access parts of the Service that are not intended for you, including administrative interfaces.
• Do not interfere with the operation of the Service, its security controls or its rate limits.
• Provide accurate information and correct it when it changes.

5. Description of ORACUL services

ORACUL brings several traditions of symbolic interpretation together in one application. Depending on the section, the Service may provide:

• Natal chart calculation and interpretation, including solar and lunar return charts.
• Daily, annual and lunar-calendar forecasts based on astrological calculations.
• Compatibility and synastry readings between two sets of birth data.
• Tarot spreads, horary (yes/no) questions and the Leela self-reflection game.
• Numerology, name analysis and name-harmony calculations.
• Dream interpretation with a personal dream journal and statistics.
• Palmistry and portrait (face) readings from photographs you upload.
• Family, friends and career sections that group other people's birth data you have entered.
• Push notifications with forecasts, affirmations, insights and birthday greetings.

6. Astrology and the entertainment nature of the Service

ORACUL provides astrology, horoscopes, compatibility readings, divination, symbolic interpretation and AI-generated content for informational and entertainment purposes only.

Astrology, tarot, palmistry, numerology, dream symbolism and face reading are not sciences, and their results are not empirically validated predictions of future events. They are traditions of symbolic interpretation and are presented as such.

Nothing in the Service is a statement of fact about your past, present or future, about your health, about other people, or about the outcome of any decision you may be considering.

You use the readings at your own discretion and remain solely responsible for the decisions you make.

7. AI-generated content

A significant part of the interpretive text in the Service is generated automatically by third-party large language models. Where this is the case, the App marks the content accordingly.

AI systems can be wrong. Generated text may be inaccurate, incomplete, internally inconsistent, outdated or simply invented, even when it reads confidently.

We apply automated validation to reduce obviously wrong or unsupported statements, but we cannot guarantee that every generated sentence is accurate or appropriate.

No specific result, tone, length or availability of AI-generated content is guaranteed. Generation may fail, be delayed, or be replaced by a calculated fallback text.

Do not treat AI-generated text as a factual claim, a diagnosis, a professional opinion, or a promise about the future.

8. No professional advice

The content of the Service must not be considered medical, mental-health, psychological, psychiatric, pharmaceutical, financial, investment, tax, insurance, legal, employment, immigration, or any other kind of professional advice.

You should not make important health, legal, financial, family or safety decisions solely on the basis of ORACUL predictions or AI responses.

Always consult a suitably qualified professional before acting on anything that affects your health, your legal position, your money or your safety.

If you are in crisis or believe you may be in danger, contact your local emergency services or a recognised crisis helpline. The Service is not a crisis resource and does not monitor what you write for signs of distress.

9. Accuracy and limitations

Astronomical calculations in the Service are performed with established ephemeris algorithms, but they depend entirely on the birth data you enter. An approximate or unknown birth time changes house cusps and several derived results.

Photograph-based sections (palmistry, portrait) depend on image quality, lighting, framing and the limits of automated image analysis. Detection can fail or misread features.

External data sources (for example place lookup or space-weather data) may be unavailable, delayed or incorrect, and some sections then fall back to calculated or cached results.

We do not warrant that any reading, score, date suggestion or forecast is accurate, complete, current or fit for any particular purpose.

10. Compatibility, predictions, natal charts and forecasts

Compatibility scores, synastry readings, daily and annual forecasts, lucky or favourable dates, marriage and deal timing suggestions, and any similar output are symbolic interpretations of astrological calculations. They are not forecasts of real events.

A low compatibility result says nothing about a real relationship, and a favourable date says nothing about the real outcome of anything you plan for that date.

Do not use the Service to decide whether to begin, continue or end a relationship, whether to hire or dismiss someone, whether to sign a contract, or whether to travel or undergo a medical procedure on a given day.

11. User-provided information

You provide the Service with your name, email address, gender, date, time and place of birth, optionally your current city, an avatar image, career details, dream texts, questions, and photographs of your hand or face.

You are responsible for what you submit. Do not submit content that is unlawful, that infringes someone else's rights, or that you are not permitted to share.

12. Information about other people entered by you

Several sections — compatibility, family, friends, colleagues, the family tree and the child name-harmony calculator — let you enter another person's name and birth data.

When you enter another person's data you act as the person responsible for it. You confirm that you have a lawful basis to provide it and, where the law of your country requires it, that person's consent.

Keep third-party entries to the minimum needed: a name and birth data. Do not enter sensitive information about other people — in particular data about health, sexual life, religious or political beliefs, trade union membership, or criminal matters.

Do not enter data about a child in a way that identifies them where you have no right to do so.

If a person whose data you entered asks you to remove it, delete the corresponding entry in the App. If they contact us directly, we may ask you to remove it or remove it ourselves.

You are responsible for any claim that arises from third-party data you entered into ORACUL.

13. Subscription and paid functionality

Parts of ORACUL are available only with an active paid subscription ("Premium"). The sections included in Premium, the price, the currency and the billing period are shown in the App before you purchase.

Prices are set per store and per country and are displayed to you by Apple or Google in your local currency, including any applicable taxes, before you confirm the purchase.

A free trial period, where offered, is described on the purchase screen. Unless you cancel before the trial ends, the trial converts into a paid subscription at the price shown.

Free features remain available without a subscription. We may change which features are free or paid, with reasonable notice for existing subscribers where required by law.

14. App Store and Google Play purchases

No purchase or subscription is concluded on the https://oracu1.com website: it is an informational page about the App and does not take payments or create accounts. Subscriptions are bought only inside the App, through the store you installed it from.

Subscriptions are sold and processed by Apple (App Store) or Google (Google Play), not by us. Your payment method, billing address and transaction history are held by the store, and we never receive your card details.

Your purchase is also subject to the terms of the store you bought it from. Where those terms conflict with these Terms on a matter of billing, the store's terms govern the billing relationship.

The App can restore purchases previously made with the same store account through the “Restore Purchases” action on the subscription screen.

Refunds are handled by the store under its own policy. We cannot issue a refund for a store purchase ourselves, although we can help you identify the transaction.

15. Cancellation and renewal

Subscriptions renew automatically for the same period unless you cancel them at least 24 hours before the end of the current period. The store charges the renewal within the 24 hours before the period ends.

You cancel a subscription in your store account settings — Apple: Settings → your name → Subscriptions; Google: Google Play → Payments and subscriptions → Subscriptions. Uninstalling the App does not cancel a subscription.

Deleting your ORACUL account does not cancel an active App Store or Google Play subscription. You must cancel it through your store account.

After cancellation you keep Premium access until the end of the period you already paid for.

If you live in the European Union, the United Kingdom or another jurisdiction with a statutory right of withdrawal for digital services, that right applies as provided by your local law and by the store's own policy.

16. Intellectual property

The Service — including its software, interface, artwork, illustrations, texts, prompts, calculation logic, card meanings, board content and the ORACUL name and logo — belongs to Artur Avtukhov or its licensors and is protected by copyright and other laws.

You receive a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on devices you own or control, for your own private use, for as long as you comply with these Terms.

You keep whatever rights you have in the content you submit — your dream texts, questions and photographs. You grant us only the licence needed to operate the Service for you: to store that content, process it, send the relevant parts to the AI providers used to generate your reading, and show the result back to you.

The readings generated for you are yours to keep and use privately. You may not resell them or present them as an independent professional service.

You may not copy, redistribute, publish, sell, decompile, reverse-engineer or create derivative works from the Service, except where such a restriction is prohibited by law.

17. Acceptable use

Use the Service as an ordinary user would: open sections, request readings, keep your journal, and manage the people you have added.

18. Prohibited use

You must not:

• Use the Service to give other people paid divination, medical, legal or financial advice.
• Upload photographs of another person without their knowledge and permission.
• Upload images that are unlawful, sexual, violent, or that depict a child.
• Enter another person's data in order to profile, monitor, harass, defame or discriminate against them.
• Use automated means to scrape, mass-request or resell content from the Service.
• Attempt to bypass authentication, application attestation, rate limits, subscription checks or usage quotas.
• Probe, scan or test the security of our infrastructure, or attempt to gain unauthorised access to any account or system.
• Submit prompts intended to make the AI produce unlawful content or to reveal internal instructions.
• Impersonate another person or misrepresent your age.
• Use the Service in a way that breaks the law where you live or where our servers operate.

19. Account suspension

We may suspend or restrict access to an account, an IP address or a device where we have reasonable grounds to believe these Terms have been breached, where the Service is being abused, or where a suspension is needed to protect the Service or other users.

Where practical and lawful, we will tell you the reason and give you an opportunity to respond. A suspension applied for abuse prevention may be applied immediately.

A suspension does not by itself entitle you to a refund of an unused subscription period unless required by applicable law.

20. Account termination

You may stop using the Service at any time and delete your account, as described in the next section.

We may terminate an account after a serious or repeated breach of these Terms, where required by law, or if we discontinue the Service.

If we discontinue the Service or terminate your account without a breach on your side, we will give reasonable notice where practical, and any statutory refund rights you hold in respect of a prepaid period continue to apply.

21. Account deletion

You can delete your account from inside the App: Profile → Delete account. You are asked to re-enter your current password, and the deletion is permanent.

You can also request deletion without the App, from any browser, at https://oracu1.com/delete-account. You enter the email address of your account, we send a one-time confirmation link to it, and the deletion happens only after you confirm on that page.

Deletion removes your account and the personal data attached to it — your profile, birth profiles, career profile, relationship groups, dream journal, palm and portrait readings, notification devices, forecast caches and access history.

Some records are kept in a form that is no longer linked to you: aggregated AI usage and cost rows are retained for operating the Service with the account reference removed, and abuse-prevention blocks continue to apply by email address or IP address so that deletion cannot be used to escape a block.

Exactly what is deleted, what is anonymised and why is described in the Privacy Policy at https://oracu1.com/privacy-policy.

Deletion is irreversible and cannot be undone. It does not cancel an App Store or Google Play subscription.

22. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that any particular reading will be produced.

Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you. Consumers in the European Union, the United Kingdom, Canada and many US states have statutory rights — including rights relating to digital content that is not as described — and those rights are unaffected.

23. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data or opportunity, arising from your use of the Service.

To the extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or 50 EUR.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded or limited.

In particular, if you are a consumer, this section applies only so far as the mandatory consumer-protection law of your country allows. Where that law gives you a broader remedy, that law prevails over this section.

24. Changes to the Service

The Service evolves. We may add, change, restrict or remove features, sections, models and interfaces, and we may change which sections require a subscription.

Where a change materially reduces what a paid subscription includes, we will give existing subscribers reasonable prior notice and, where the law requires it, the option to cancel and receive a proportionate refund of the remaining prepaid period through the relevant store.

25. Changes to these Terms

We may update these Terms. Each revision carries a version number and an effective date, both shown at the top of this document.

When you registered, we recorded the version of the Terms you accepted. Continuing to use the Service after a new version takes effect does not by itself replace that record: where a change is material, we will ask you to review and accept the new version in the App.

If you do not accept a new version, you may stop using the Service and delete your account.

26. Governing law and regional consumer protections

These Terms are governed by the law of Italy, without regard to its conflict-of-law rules.

This choice of law does not deprive you of the protection of the mandatory rules of the country where you habitually reside. If you are a consumer in the European Economic Area, the United Kingdom, Canada or the United States, you keep the protections and the right to bring proceedings that your local law gives you.

EU consumers may also use the European Commission's online dispute resolution platform, and consumers in Quebec, Canada and in several US states have specific statutory rights that these Terms do not restrict.

Nothing in these Terms requires you to waive a right that cannot be waived under the law that applies to you, and no provision of these Terms applies to the extent that it is prohibited by that law.
